In 1972, the Federal Water Pollution Control Act, also known as the Clean Water Act (CWA), was amended to prevent the illegal discharge of pollutants to waters of the United States, (river, stream, pond, lake, ditch) unless the discharge was permitted under the National Pollutant Discharge Elimination System (NPDES). To become permitted, a facility must supply information on the processes and operations of the company and analytical data for each discharge it may have. Once permitted, the facility must comply with various terms and conditions, including periodic sampling, analysis, and development of a Best Management Practices (BMP) Plan.
Additional amendments to the CWA in 1987 established a program that required NPDES permitting of point source discharges of storm water associated with industrial facilities. A facility may choose one of three options to obtain coverage under this permit. These include applying for a group, individual, or general permit, and complying with the conditions of the permit issued. Again, the conditions can include periodic sampling, analysis, and development of a Storm Water Pollution Prevention Plan (SWPPP).
